Terms of Service
Last updated and effective 1 October 2026
These terms are an agreement between you and PURE Care. Please read them before you use PURE Care. If you join our waitlist, they apply to you from that moment.
1. What PURE Care is
PURE Care ('we', 'us') provides a digital service that helps individuals and families organise, digitise, store and look up medical records, prescriptions and health cards.
We are a technology platform and an 'intermediary' within the meaning of section 2(1)(w) of the Information Technology Act, 2000.
We do not give medical advice, clinical opinions, diagnoses or treatment plans. We are not a doctor, clinic, hospital, emergency service or pharmacy. Everything we show you, including summaries, automated readings and notifications, is for information and organisation only. Always ask a qualified treating doctor about any medical condition or medicine schedule.
2. Who may use it, and acting for a family member
You must be at least 18 years old.
You may upload records for yourself, or for a parent or family member, only if (a) they have given you their informed consent, in writing, or (b) you are their legally appointed guardian or hold an active Power of Attorney.
You promise that you have the legal authority to share every piece of personal and health information you give us. You agree to protect PURE Care, its founders and its employees against any claim, investigation or loss caused by you uploading or managing someone's health information without that authority.
3. Your account
You sign in with an email code or with Google. Keep your sign-in safe. You are responsible for what happens under your account.
If you think someone else has got into your account, tell us straight away at prakash@upwords.in.
4. Reading documents with software, and our care team's review
We use optical character recognition, artificial intelligence and other software to read, organise and index the documents you upload.
Handwritten prescriptions, faded documents and complex reports are hard for any software to read, and mistakes can happen.
Our care team reviews what the software has read to help keep records clear and complete. We do not promise that a reading is clinically accurate or complete. Please check anything important against the original document before you rely on it.
5. Medicine refills
PURE Care does not sell, stock, dispense or deliver medicines. Every refill order is fulfilled by an independent, licensed partner pharmacy.
No prescription medicine is supplied without a valid, legible prescription from a registered medical practitioner. The pharmacy may confirm a prescription by phone with a doctor.
You will see an itemised price before anything is dispatched. The partner pharmacy is the seller. You pay on delivery, or through the pharmacy's own payment options, and the pharmacy issues the invoice. We are not responsible for how well a medicine works, for delivery delays, for damaged packaging or for dispensing errors by the pharmacy.
6. Fees, cancellation and refunds
Joining the waitlist is free. When paid plans open, we will show you the price, what it includes and how billing works before we charge you anything, and we will update these terms.
Until an online billing page exists, you can cancel, or ask a question about a charge, by writing to us at the address on our grievance page.
The free home health kit is a set of printable sheets we email to you. It is provided as it is, without any promise that it suits your needs.
Medicine returns and refunds (refunds section): you can return a medicine at the time of delivery if its packaging is damaged, if it is expired, or if it does not match the prescription. Once you have accepted and signed for a prescription medicine, it cannot be returned or refunded, in line with the Drugs and Cosmetics Rules, 1945. If a medicine is verified as damaged or wrongly dispensed, the partner pharmacy will arrange a replacement or refund, usually within 7 to 10 working days.
7. Emergencies
PURE Care is not an emergency service and is not watched in real time. Nobody is monitoring your account at any hour.
In an emergency, or for sudden pain, chest discomfort or a sudden change in health, call 108 or 112 straight away, or take the person to the nearest hospital emergency department. PURE Care does not take on any duty of care or clinical responsibility for medical complications that arise while you use it.
8. What you must not do
You must not (a) upload unlawful, defamatory, obscene or fraudulent documents; (b) pretend to be a doctor, a patient or a family member; (c) try to copy, scrape, probe or break into our software or systems; or (d) use PURE Care to get controlled or prohibited substances, including Schedule X drugs.
9. Your information
How we handle personal information, health records and message details is set out in our Privacy notice at https://www.thepurecare.com/privacy. By using PURE Care you accept that handling, in line with the Digital Personal Data Protection Act, 2023.
10. Limit of our liability
As far as Indian law allows, our total liability to you for anything connected with PURE Care is limited to the fees you paid us in the three months before the claim, or Rs 1,000, whichever is more.
We are not liable for indirect, special, incidental or consequential loss, or for any harm from medical complications, missed or incorrect diagnoses, death, loss of data, or reliance on information shown in PURE Care.
11. Indemnity
You agree to defend and protect PURE Care and its people against any third-party claim, loss or legal cost that arises from (i) your breach of these terms, (ii) your uploading medical records without lawful consent or authority, or (iii) your breaking any law.
12. Governing law and disputes
These terms are governed by the laws of India.
Any dispute about these terms will be settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator both sides agree on. The seat and venue are in India and the language is English.
Subject to that, the courts in India have exclusive jurisdiction.
